ITEM DESCRIPTION QTY U/M UNIT PRICE EXTENSION IN ACCORDANCE WITH THE PROVISIONS OF THE ORIGINAL PURCHASE ORDER (PO) EV000790, REQUEST FOR OFFER IT826893 AND ALL AMENDMENTS, THIS RENEWAL IS HEREBY ISSUED. THIS IS THE FOURTH AND FINAL RENEWAL OPTION. UNLESS NOTED HEREIN, ALL PRICES, TERMS AND CONDITIONS OF SAID ORDER REMAIN UNCHANGED. THIS IS FOR THE PURCHASE OF EQUIPMENT AND SOFTWARE AND MAINTENANCE FOR THE FACILITIES DIVISION. SERVICE DATES: 09/01/2020 THROUGH 08/31/2021 PURCHASED IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF DIR CONTRACT DIR-TSO-3101. ON-GOING MAINTENANCE AND REPAIRS ARE AT NO CHARGE UP TO 25,000 SQUARE FEET. SHALL INCLUDE AN ADDITIONAL SCANNER, TRAY AND COMPUTER WORKSTATION AT NO ADDITIONAL COST TO THE AGENCY, TO ALSO BE COVERED IN ALL SOFTWARE AND MAINTENANCE SUPPORT. THE TDCJ RESERVES THE RIGHT TO CHANGE THE ORDER VIA A PURCHASE ORDER CHANGE ORDER (POCN). SERVICE RESPONSE FOR MAINTENANCE REPAIR CALLS SHALL NOT EXCEED TWELVE (12) HOURS. E-VERIFY SYSTEMS: THE TDCJ SHALL REQUIRE THE FOLLOWING AS A CONDITION OF ALL SERVICE CONTRACTS: BY ENTERING INTO THIS CONTRACT, THE CONTRACTOR CERTIFIES AND ENSURES THAT IT UTILIZES AND WILL CONTINUE TO UTILIZE, FOR THE TERM OF THIS CONTRACT, THE U.S. DEPARTMENT OF HOMELAND SECURITY'S E-VERIFY SYSTEM TO DETERMINE THE ELIGIBILITY OF: 1. ALL PERSONS EMPLOYED TO PERFORM DUTIES WITHIN TEXAS, DURING THE TERM OF THE CONTRACT; AND 2. ALL PERSONS (INCLUDING SUBCONTRACTORS) ASSIGNED BY THE RESPONDENT TO PERFORM WORK PURSUANT TO THE CONTRACT, WITHIN THE UNITED STATES OF AMERICA. THE CONTRACTOR SHALL PROVIDE, UPON REQUEST OF THE TDCJ, AN ELECTRONIC OR HARDCOPY SCREENSHOT OF THE CONFIRMATION OR TENTATIVE NON-CONFIRMATION SCREEN CONTAINING THE E-VERIFY CASE VERIFICATION NUMBER FOR ATTACHMENT TO THE FORM I-9 FOR THE THREE MOST RECENT HIRES THAT MATCH THE CRITERIA ABOVE, BY THE CONTRACTOR, AND CONTRACTOR'S SUBCONTRACTORS, AS PROOF THAT THIS PROVISION IS BEING FOLLOWED. IF THIS CERTIFICATION IS FALSELY MADE, THE CONTRACT MAY BE IMMEDIATELY TERMINATED, AT THE DISCRETION OF THE STATE AND AT NO FAULT TO THE STATE, WITH NO PRIOR NOTIFICATION. THE CONTRACTOR SHALL ALSO BE RESPONSIBLE FOR THE COSTS OF ANY RE-SOLICITATION THAT THE STATE MUST UNDERTAKE TO REPLACE THE TERMINATED CONTRACT. THE VENDOR SHALL PROVIDE AN ADEQUATE PLAN OF INSURANCE THAT PROVIDES: 1) COVERAGE TO PROTECT THE TEXAS DEPARTMENT OF CRIMINAL JUSTICE (TDCJ) AGAINST ALL CLAIMS ARISING FROM SERVICE PERFORMED BY THE VENDOR. 2) COVERAGE TO PROTECT THE TDCJ FROM ACTIONS BY A THIRD PARTY AGAINST THE VENDOR OR ANY SUBCONTRACTOR(S) OF THE VENDOR AS A RESULT OF THIS CONTRACT. COVERAGE TO PROTECT THE TDCJ FROM ANY ACTIONS BY OFFICERS, EMPLOYEES, AGENTS, THE VENDOR OR ANY SUBCONTRACTOR(S). THE VENDOR SHALL NOT COMMENCE WORK UNDER THIS CONTRACT UNTIL VENDOR HAS OBTAINED ALL THE INSURANCE REQUIRED AND CERTIFICATES OF SUCH INSURANCE HAVE BEEN FILED AND ACCEPTED BY THE TDCJ.
